Tennessee Consumer Protection

The Tennessee Consumer Protection Act prohibits the use of unfair or deceptive acts or practices affecting the conduct of any trade or commerce. Such conduct includes, but is not limited to, representing that goods or services are of a particular standard or quality when they are not, or falsely disparaging the goods, services or business of another. In addition, advertising goods or services with the intent not to sell them as advertised is prohibited. Representing that a service, replacement or repair is needed when it is not is also a deceptive act or practice. Any person who suffers a loss of money or property as a result of a violation of the Consumer Protection Act has a right to bring suit to recover damages, and, if the Court finds that the unfair or deceptive act or practice was a willful or knowing violation, the court may award three times the actual damages. In addition, the court may award to a successful plaintiff reasonable attorneys fees and costs.
